The market might be a niche, but offering products with the guarantee of safety is the only way to steadily develop the market beyond risk-taking explorers. With leading manufacturers based either in the US or Europe, the approach to the European &#8216;Union&#8217;s &#8220;Conformit\u00e9 Europ\u00e9enne&#8221; \u2013 <em data-renderer-mark=\"true\">European Conformity in French<\/em> &#8211; or CE marking shows sharp cultural differences regarding trade and regulation. The pain point is that it isn&#8217;t cheap.<\/p>\n<p data-renderer-start-pos=\"618\">With <a class=\"css-tgpl01\" title=\"https:\/\/rebreatherforum.tech\/\" href=\"https:\/\/rebreatherforum.tech\/\" target=\"_blank\" rel=\"noopener\" data-testid=\"link-with-safety\" data-renderer-mark=\"true\"><strong data-renderer-mark=\"true\">Rebreather Forum 4<\/strong><\/a> taking place in Malta (20-22 April 2023), which means for the first time in the European Union (EU), we talked with manufacturers based in the US and Europe. Lamar Hires of DiveRite and Bertrand Hemard of M3S (manufacturing the Triton CCR) shared their views regarding CE marking for rebreathers. Chauncy Chapman, an engineering consultant with international diving equipment companies, and Mark Caney, who is in charge of standardisation for PADI, also offered further information to complete our understanding of the issue as of 2023.<\/p>\n<p data-renderer-start-pos=\"1180\">On each side of the Atlantic, the <a class=\"css-tgpl01\" title=\"https:\/\/standards.iteh.ai\/catalog\/standards\/cen\/78062ec7-c812-436e-bf31-735fe2bc80e4\/en-14143-2013#:~:text=Slovenian-,Respiratory%20equipment%20%2D%20Self%2Dcontained%20re%2Dbreathing%20diving%20apparatus,safe%20operation%20of%20the%20apparatus.\" href=\"https:\/\/standards.iteh.ai\/catalog\/standards\/cen\/78062ec7-c812-436e-bf31-735fe2bc80e4\/en-14143-2013#:~:text=Slovenian-,Respiratory%20equipment%20%2D%20Self%2Dcontained%20re%2Dbreathing%20diving%20apparatus,safe%20operation%20of%20the%20apparatus.\" target=\"_blank\" rel=\"noopener\" data-testid=\"link-with-safety\" data-renderer-mark=\"true\"><strong data-renderer-mark=\"true\">EN14143 standard<\/strong><\/a>, which addresses self-contained re-breathing diving apparatus and was first published in 2003, is recognised as an excellent basis of work to measure CCR performances, such as work of breathing or scrubber endurance. Unfortunately, being an EU standard, only manufacturers based in EU member countries can sit at the standardisation committee table (after all, EU taxpayers finance all these committees). Yet, the frustration for American manufacturers doesn&#8217;t stop there as the CE marking process goes beyond testing.<\/p>\n<p data-renderer-start-pos=\"1180\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-11387639 \" src=\"https:\/\/alertdiver.eu\/wp-content\/uploads\/2023\/07\/Chauncey-Chapman.jpg\" alt=\"\" width=\"542\" height=\"626\" srcset=\"https:\/\/alertdiver.eu\/wp-content\/uploads\/2023\/07\/Chauncey-Chapman.jpg 865w, https:\/\/alertdiver.eu\/wp-content\/uploads\/2023\/07\/Chauncey-Chapman-260x300.jpg 260w, https:\/\/alertdiver.eu\/wp-content\/uploads\/2023\/07\/Chauncey-Chapman-768x888.jpg 768w, https:\/\/alertdiver.eu\/wp-content\/uploads\/2023\/07\/Chauncey-Chapman-700x809.jpg 700w\" sizes=\"auto, (max-width: 542px) 100vw, 542px\" \/><\/p>\n<p style=\"text-align: center;\" data-renderer-start-pos=\"1180\"><em data-renderer-mark=\"true\"><span id=\"9cb1ccc0-dde3-4ec0-b51b-a64778747a04\" data-renderer-mark=\"true\" data-mark-type=\"annotation\" data-mark-annotation-type=\"inlineComment\" data-id=\"9cb1ccc0-dde3-4ec0-b51b-a64778747a04\">&#8220;EN14143 is a really good document, I couldn&#8217;t come up with something better&#8221;<\/span><\/em><span id=\"9cb1ccc0-dde3-4ec0-b51b-a64778747a04\" data-renderer-mark=\"true\" data-mark-type=\"annotation\" data-mark-annotation-type=\"inlineComment\" data-id=\"9cb1ccc0-dde3-4ec0-b51b-a64778747a04\"> \u2013 Chauncey Chapman<\/span><\/p>\n<h3 id=\"The-Devil's-in-the-Details\" data-renderer-start-pos=\"1852\">The Devil&#8217;s in the Details<\/h3>\n<p data-renderer-start-pos=\"1880\">Since the 1990s, CE marking has become a staple across industries to access the European market. We sometimes forget or misunderstand it covers different realities: self-declaration or certification. Like open circuit regulators, CCR units fall under the <strong data-renderer-mark=\"true\">PPE<\/strong> directive (<strong data-renderer-mark=\"true\">Personal Protection Equipment<\/strong>). The directive requires the CE marking to be taken to the level of certification in the case of breathing apparatus. In legal terms, it means that product quality controls need to be audited by a third-party notified body in addition to performance tests. <span id=\"2fd7ada3-45f4-460f-b36d-e03e7f90f55a\" class=\"inline-highlight first-mark-highlight last-mark-highlight\" data-renderer-mark=\"true\" data-mark-type=\"annotation\" data-mark-annotation-type=\"inlineComment\" data-id=\"2fd7ada3-45f4-460f-b36d-e03e7f90f55a\">Any modification or evolution to the unit has to be checked by the notified body; they will then decide if it has to go through the entire process or not*.<\/span><\/p>\n<p data-renderer-start-pos=\"2594\">Note that various products can get CE marking with only a declaration of conformity signed by the manufacturer. This document states their products meet the EU standards&#8217; requirements: this is called self-declaration. When a certification is mandatory, working with a notified body comes at a much higher price. While American manufacturers wish they could skip the extra cost (note, not the testing), European manufacturers know they cannot opt out even if they wanted to serve other countries than within the EU.<\/p>\n<p data-renderer-start-pos=\"3110\">We could debate for hours who is right or wrong about more government interventionism to prevent accidents by anticipation or let manufacturers self-regulate to give more space for innovation. The spirit of the law in each region, between upstream regulation and legal precedents, explains most of the difference in attitude. However, we can&#8217;t ignore that CE marking is also an international trade barrier. By elevating the standards and asking for a neutral accredited organisation to intervene, the EU aims to protect its local industry.<\/p>\n<p data-renderer-start-pos=\"3110\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-11387648 size-full\" src=\"https:\/\/alertdiver.eu\/wp-content\/uploads\/2023\/07\/Lamar-Hires.jpg\" alt=\"\" width=\"1000\" height=\"667\" srcset=\"https:\/\/alertdiver.eu\/wp-content\/uploads\/2023\/07\/Lamar-Hires.jpg 1000w, https:\/\/alertdiver.eu\/wp-content\/uploads\/2023\/07\/Lamar-Hires-300x200.jpg 300w, https:\/\/alertdiver.eu\/wp-content\/uploads\/2023\/07\/Lamar-Hires-768x512.jpg 768w, https:\/\/alertdiver.eu\/wp-content\/uploads\/2023\/07\/Lamar-Hires-700x467.jpg 700w\" sizes=\"auto, (max-width: 1000px) 100vw, 1000px\" \/><\/p>\n<p style=\"text-align: center;\" data-renderer-start-pos=\"3110\"><em data-renderer-mark=\"true\">&#8220;CE marking is slowing down innovation&#8221;<\/em> \u2013 Lamar Hires, DiveRite<\/p>\n<p data-renderer-start-pos=\"3719\">Frustration also builds up since the CCR global market is in a catch-22 position. It is still too small to ignore the European market, which now represents the largest installed base of sport rebreathers, surpassing North America. Hence, American manufacturers need to pay for their access. In the case of their European counterparts, they have no choice but to do the same, whatever market they target.<\/p>\n<p data-renderer-start-pos=\"4124\">But for both, the cost of CE marking today seems disproportionate compared to the market size. On average, manufacturers must spend between 20,000 and 40,000 (EUR or USD) to get their CE marking for one model. Then, there are a few thousand more each year since the notified body will control one unit from production per year.<\/p>\n<p data-renderer-start-pos=\"4453\">To be more specific, the testing of the scrubber alone takes 4 to 5 days to achieve. Then another week is needed for the rest of the required performance tests. Knowing a day at a testing facility costs around 3000$ a day, it&#8217;s easy to do the maths. But the spending doesn&#8217;t stop there.<\/p>\n<p data-renderer-start-pos=\"4741\">If manufacturers can use laboratories in Europe or North America and then save on logistics, they still need a representative of their chosen notified body to come in person (with all the associated costs). The notified body must also visit the manufacturing facility to audit the quality control system (with new associated costs). Only being ISO 9001 certified (standards for quality control systems) can make the process easier and quicker. Very few CCR manufacturers are today because you must spend more money to be ISO 9001 certified. To sum up and give you a more palpable understanding, to get the CE marking, each CCR manufacturer needs to sell between 20 to 40 units to cover its cost. Ouch.<\/p>\n<p data-renderer-start-pos=\"4741\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-11387657 size-full\" src=\"https:\/\/alertdiver.eu\/wp-content\/uploads\/2023\/07\/Bertrand-Hemard.jpg\" alt=\"\" width=\"1000\" height=\"667\" srcset=\"https:\/\/alertdiver.eu\/wp-content\/uploads\/2023\/07\/Bertrand-Hemard.jpg 1000w, https:\/\/alertdiver.eu\/wp-content\/uploads\/2023\/07\/Bertrand-Hemard-300x200.jpg 300w, https:\/\/alertdiver.eu\/wp-content\/uploads\/2023\/07\/Bertrand-Hemard-768x512.jpg 768w, https:\/\/alertdiver.eu\/wp-content\/uploads\/2023\/07\/Bertrand-Hemard-700x467.jpg 700w\" sizes=\"auto, (max-width: 1000px) 100vw, 1000px\" \/><\/p>\n<p style=\"text-align: center;\" data-renderer-start-pos=\"4741\"><em data-renderer-mark=\"true\">&#8220;Very few testing laboratories are accredited, so a representative of the notified body needs to come over to assess the tests&#8221;<\/em> \u2013 Bertrand Hemard, M3S<\/p>\n<p data-renderer-start-pos=\"4741\">One way to partially solve the issue would be to take the ISO standards route. <strong data-renderer-mark=\"true\">ISO<\/strong> (<strong data-renderer-mark=\"true\">International Standard Organisation<\/strong>) is the only globally recognised organisation. But taking this route has a cost too, and it isn&#8217;t quick. At least, all manufacturers could sit at the standardisation committee table and bring their best ideas. For instance, there would be a better method to test scrubbers that would be both more reliable and cheaper (e.g., <a class=\"css-tgpl01\" title=\"https:\/\/gue.com\/blog\/low-cost-rebreather-testing-why-and-how\/\" href=\"https:\/\/gue.com\/blog\/low-cost-rebreather-testing-why-and-how\/\" target=\"_blank\" rel=\"noopener\" data-testid=\"link-with-safety\" data-renderer-mark=\"true\"><strong data-renderer-mark=\"true\">SNORT &#8211; Surface Normalized One-Atmosphere Rebreather Tester<\/strong><\/a>).<\/p>\n<h3 id=\"CCR-training-standards:-EN-+-ISO\" data-renderer-start-pos=\"6107\">CCR training standards: EN + ISO<\/h3>\n<p>CCR standards come in two flavours: equipment and training. It is worth noting that training agencies took the ISO route as early as 1999. After more than 20 years of work, the two first ISO standards for CCR training were finally published in 2022, and three others are on their way. It seems manufacturers could use the experience of the training agencies to embark on a similar journey. It won&#8217;t reduce the cost, but at least all manufacturers could have their say as the training agencies do. When an ISO standard is published, the EU harmonises its EN standards based on it.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-11387666 \" src=\"https:\/\/alertdiver.eu\/wp-content\/uploads\/2023\/07\/Mark-Caney.jpg\" alt=\"\" width=\"573\" height=\"573\" srcset=\"https:\/\/alertdiver.eu\/wp-content\/uploads\/2023\/07\/Mark-Caney.jpg 1000w, https:\/\/alertdiver.eu\/wp-content\/uploads\/2023\/07\/Mark-Caney-300x300.jpg 300w, https:\/\/alertdiver.eu\/wp-content\/uploads\/2023\/07\/Mark-Caney-768x768.jpg 768w, https:\/\/alertdiver.eu\/wp-content\/uploads\/2023\/07\/Mark-Caney-570x570.jpg 570w, https:\/\/alertdiver.eu\/wp-content\/uploads\/2023\/07\/Mark-Caney-500x500.jpg 500w, https:\/\/alertdiver.eu\/wp-content\/uploads\/2023\/07\/Mark-Caney-700x700.jpg 700w\" sizes=\"auto, (max-width: 573px) 100vw, 573px\" \/><\/p>\n<p style=\"text-align: center;\"><em data-renderer-mark=\"true\"><span class=\"fabric-text-color-mark\" data-renderer-mark=\"true\" data-text-custom-color=\"#36b37e\">&#8220;Most products and services benefit from standardisation, it simplifies trade and protect from liability&#8221; <\/span><\/em><span class=\"fabric-text-color-mark\" data-renderer-mark=\"true\" data-text-custom-color=\"#36b37e\">\u2013 Mark Caney, PADI<\/span><\/p>\n<p data-renderer-start-pos=\"6725\">CE marking might be a necessary evil, but American manufacturers should appreciate that this single process gives them access to 30 countries (EU member states and EEA signatory countries). The aftermath of Brexit is not complete yet, and it means that manufacturers will have to go through another process if they want to keep access to the UK market, which remains vital to the CCR market.<\/p>\n<p data-renderer-start-pos=\"7244\">Is it a never-ending nightmare? The only answer that makes sense today is to start working as soon as possible on ISO CCR standards but also embrace ISO 9001 quality system certification since it dramatically simplifies the acquisition of any form of certification.<\/p>\n<p data-renderer-start-pos=\"7511\">As the French CEO of M3S, Bertrand Hemard, points out, &#8220;<em data-renderer-mark=\"true\">Standards and labels are here to answer a need for safety&#8221;,<\/em> which is key to expanding the CCR market. While doing so, it should allow making certification costs more bearable.<\/p>\n<p data-renderer-start-pos=\"7511\">\n<p data-renderer-start-pos=\"7511\"><span id=\"ba2412ed-891e-4b54-b573-fa340f14f9f5\" class=\"inline-highlight first-mark-highlight\" data-renderer-mark=\"true\" data-mark-type=\"annotation\" data-mark-annotation-type=\"inlineComment\" data-id=\"ba2412ed-891e-4b54-b573-fa340f14f9f5\">*<\/span><em data-renderer-mark=\"true\"><span id=\"ba2412ed-891e-4b54-b573-fa340f14f9f5\" class=\"inline-highlight last-mark-highlight\" data-renderer-mark=\"true\" data-mark-type=\"annotation\" data-mark-annotation-type=\"inlineComment\" data-id=\"ba2412ed-891e-4b54-b573-fa340f14f9f5\">Compliance with CE certification regulations necessitates manufacturer approval for any modifications made to a CCR unit.
